Is being sectioned under the mental health act a criminal record?

No, it's a health thing, not criminal.

It is if it's Court Ordered. One way or the other, it will show if a background check is run.

no, it's a psychiatric record.

No. However if you've been detained by the police under a section 136 the police can disclose this on an enhanced DBS check if they feel that it's relevant. I don't agree with it but there's nothing you can do.
